The Importer of Record (IOR) is the legally responsible party for ensuring that goods are imported into India in full compliance with all applicable laws and regulations. The IOR can be the buyer, seller, or a third-party service provider with a legal presence in India. Here’s how the process works:
Once goods are ready for shipment, the IOR is designated to take charge of the import process. The IOR prepares and files the necessary documents with Indian Customs, including the Bill of Entry, commercial invoice, packing list, product classification under HS Code, and any mandatory certifications or licenses (such as BIS, WPC, or EPR registration for electronic or battery products).
The IOR is responsible for paying all applicable customs duties, GST, cess, and other import fees. They ensure that the shipment complies with Indian import regulations—this includes adhering to product standards, labeling norms, and handling restrictions on controlled goods.
During customs clearance, the IOR coordinates with customs authorities, responds to queries, and ensures that the goods are legally cleared. Once cleared, the shipment is handed over to the consignee or final recipient.
Post-import, the IOR must maintain records of the import transaction and ensure compliance in case of audits or inspections.
In short, the IOR serves as the legal and compliance backbone of the import process, ensuring smooth and lawful entry of goods into India.
