MOOWR warehouse infrastructure is governed by Regulation 8 of the MOOWR (No. 2) Regulations, 2019, which requires the licensee to provide such facilities, equipment, and personnel as are sufficient to control access to the warehouse, provide secure storage of the goods, and ensure compliance with the regulations under the Customs Act, 1962.
Note what that does not say. A fully enclosed structure is not required, and many applicants over-build on the strength of guidance that says otherwise.
CBIC has stated the position plainly. The regulations do not mandate that a structure fully closed from all sides is a prerequisite for grant of licence.
What matters is that the site or building is suitable for secure storage of dutiable goods and for discharge of compliances. Depending on the nature of the goods, the operations, and the industry, some units may operate without fully closed structures. An open yard handling heavy engineering goods can qualify where a sealed shed would be impractical.
The three obligations are access control, secure storage, and the personnel and equipment to discharge compliance. In practice that resolves into:
Customs conducts a one-time physical verification before granting the licence. The bond officer records findings on security, fire protection, the IT-enabled inventory management system, type of construction, and the area available for examination of goods if required.
The Principal Commissioner takes into account the nature of the premises and the facilities, equipment, and personnel put in place for secure storage. The facility must be ready on inspection day, not shortly afterwards.
MOOWR warehouse infrastructure extends beyond the physical. Regulation 4 requires accounts of receipt and removal to be maintained in digital form and furnished digitally to the bond officer monthly. Paper is not an option.
The software must incorporate an audit trail: a secure, computer-generated, time-stamped record allowing reconstruction of the creation, modification, or deletion of any entry. Updated digital copies must also be held at a location other than the warehouse, against loss by natural calamity.
Applicants who present concrete evidence of readiness fare better. A documented CCTV layout, an ERP-based record system demonstrably linked to the prescribed account format, and named personnel with defined responsibilities all shorten the assessment.
Licence issuance commonly takes two to three months from a complete application. Facility readiness at inspection is the variable most within your control.
A warehouse keeper with sufficient experience in warehousing operations and customs procedures must be appointed. A person who has passed the Customs Broker Regulations examination qualifies, though that is not the only route.
He signs the accounts, verifies quantities, endorses bills of entry and transfer forms, and reports discrepancies to the bond officer within twenty-four hours. A digital signature certificate is required for electronic filings.
Transportation from a customs station to the warehouse, between warehouses, or to a customs station for export takes place under a secure one-time lock. Goods are not under customs escort during movement, so the seal and its verification carry the burden.
An all-risk insurance policy covering the deferred customs duty amount must be in place, along with transit risk cover for inter-warehouse movements.
There is no day-to-day presence of customs officers in a Section 65 warehouse. Supervision shifted to the self-appointed warehouse keeper, and audits are risk-based with no prescribed frequency. Your MOOWR warehouse infrastructure therefore has to be self-policing.
